We received some good comments at the time.Especially from women.
Then we came back from our cultural sojourn to find this in our inbox
Dear Sir/Madam,
Re: http://roarprawn.blogspot.com/ 2010/04/mistressology.html
My name is Ms. Kala Elliott and I am the owner of the Trademark 'Mistressology'. The application was made last year on my behalf by my UK patent agent Kingsly and Talboys who have been my agents for many years. I am the author of the forthcoming book entitled Mistressology and am requesting that you please change the title of your post so the public do not confuse my work with yours. I have already reported this matter to blogspot.com

Well we consulted some mates who suggested that we ignore it. One proferred that if the woman was serious we would have got a lawyers letter.
So we did ignore it.
Then last night we got this slightly more insistent email demanding we remove the post.

There is a blogger by the name of BustedBlonde using my trademark on her blog which is inked to your network. Here is the location of the infringement:

I have emailed her/him informing her/him of the situation but have not had a reply.

We were struggling to understand why Ms Elliot had her knickers in a twist. It appears that when you plonk the word Mistressology in google - it goes to my post on Mistressology and not her blog .

So we will do - nothing. Interesting there is no use of the copyright symbol or the trademark symbol on her blog which is standard practice if you have gone to the expense of tradmarking something. We have used the word as a descriptor in a title of a post in a iddy biddy blog a world away from Mistressology and her interesting take on gender politics. Hardly worth calling in the legal beagles. She would be better to hire a socail media/internet expert to show her how to get better profile on the net.

One does wonder if such letters of patent or whatever she has have any standing outside of the UK.
Readers- pay them a visit and make your thoughts know- I have!
Wonderful irony, by the way- the feminazi preaching empowerment trying to censor another woman's blog!
I think this person deserves a variation of the Arkell Defence:

I'd email to her lawyers and tell them to earn their fee and explain to their client exactly what rights she got with the TMs, and her potential liabilities under section 21 of the Trade Marks Act 1994 (Remedy for groundless threats of infringement proceedings), particularly if blogger.com or Google take any action against you.
On the other hand looking at the lawyers email address one has to doubt they do much more than file the papers and collect the fee.
The term isn't trademarked in NZ, coz I just searched it.
While it may be in the UK, that doesn't stop you from using it here.
Tell you what, trademark it here and then tell her to F Off.
Sagenz: I gather (from Stephen Stratford's "Quote Unquote" site - that Metro Mag used it at least once.
She is jealous because your blog comes up more frequently than her site. That is just pathetic.
I see that you have had lots of good advice and support but wanted to add mine.
Kia kaha
